疑窺婦洗澡 事證不足不起訴

（中央社記者沈如峰宜蘭16日電）宜蘭一名蔡姓男子被控偷窺婦女洗澡，但警方沒在蔡男身上找出藉以窺視的工具設備，認為證據無法構成妨害秘密罪，將蔡男處分不起訴。

法界人士表示，刑法「窺視竊聽竊錄罪」的構成要件，必須是「無故利用工具或設備」進行，像是拿望遠鏡偷窺、裝針孔竊錄等，如果僅是透過現成孔洞窺視，就不構成刑責，只能以違反社會秩序維護法裁罰。

根據宜蘭地檢署今天公布的不起訴書，蔡男今年6月9日凌晨，在羅東鎮一處民宅，透過浴室氣窗偷窺婦女洗澡，遭婦女的丈夫告發。

蔡男被警方查獲後辯稱，他只是聽到異常水聲才前往查看，不是故意窺視；警方在現場也沒有查到用來窺視或錄影的設備。1021016
