控通姦不成 醫生娘獲賠40萬

（中央社記者陳淑芬台中28日電）黃姓醫師被妻控告與女學生同居通姦，法院以不足證明姦淫，無罪定讞。黃妻再提民事向女學生求償，一審獲判賠新台幣40萬元。

台中市某醫學中心黃姓醫師的妻子控告黃與小他20歲的沈姓女學生自民國99年同居，沈女100年間懷孕，由黃陪同到婦產科做羊膜穿刺檢查，黃並在手術及麻醉同意書簽名，簽下與沈女關係為「夫妻」。

台中高分院以相關事證僅能證明黃與沈關係非比尋常，有令人非議之處，但2人拒絕接受測謊及胎兒DNA檢驗，無法證實有通姦行為，今年2月間判處無罪定讞。

黃妻另向沈女提出損害賠償告訴，指控黃醫師與沈女發展男女關係，同居生子，甚至導致黃對她提出離婚訴訟，請求賠償精神撫慰金新台幣100萬元。

台中地院民事判決書指出，黃與沈女過從甚密，有令人非議之處，行為舉止足以破壞黃夫妻間的生活圓滿幸福，且沈女不願和解或表示悔意，判賠40萬元。全案仍可上訴。1020628
