《民法》修正　父母的善意也列入監護權裁量

【李英婷／台北報導】過去時有耳聞名人夫妻離婚時爭奪監護權，透過「先搶先贏」方式，拒絕另一方探視，或利用媒體塑造有利情境，影響法官裁判，立法院今三讀修正通過《民法》第1055 -1條修正案，新增「善意父母條款」，未來法官裁量監護權，應審酌「父母之一方是否有妨礙他方對未成年子女權利義務行使負擔之行為」，假設父母隱匿子女、將子女拐帶出國，很可能被法官列為不適任監護人。

此外，同案也明定，未來法官在裁判親權時，除得參考社工人員之訪視報告或家事調查官之調查報告外，並得依囑託警察機關、稅捐機關、金融機構、學校及其他有關機關、團體或具有相關專業知識之適當人士就特定事項調查之結果認定之，讓裁判更為符合子女利益。
