假球案求償 中華職棒敗訴定讞

（中央社記者蔡沛琪台北25日電）中華職業棒球大聯盟不滿前兄弟象教練中入伸操控球員打假球，重創商譽而求償。最高法院認定中職並非詐欺被害人，判敗訴。

根據法院今天公布判決，中職主張，中入伸從民國94年起配合不法綁球集團，以「打假球真詐財」手段說服或脅迫球員配合打假球，重創中職形象、商譽及信用，導致廣告收入及廠商贊助大減，提起刑事附帶民事訴訟，求償新台幣2億1000萬元。

中入伸否認侵害中職名譽，辯稱中職並非犯罪行為被害人，也未舉證受到損害。一審認定中職並非假球案受損的直接被害人，判決中職敗訴。

案件上訴台灣高等法院，合議庭根據刑事判決，認定假球案被害人是遭中入伸打假球詐騙的賭客，而非中職；至於中職廣告收入及廠商贊助大減是假球案衍生的效應，判決中職敗訴。最高法院駁回上訴，全案確定。

中入伸刑事責任部分，台灣高等法院依詐欺罪判處1年8月徒刑，緩刑4年確定，並應向公庫支付180萬元。1021125
