林克穎案 英法官認定台灣為政治實體

英國愛丁堡地方法院今天開庭審理林克穎引渡案，法官甫開庭即裁示，台灣具有「領地」地位的政治實體，隨即進行實質審理。法官的認定對我國是一大利多，訴訟程序中已先打贏程序戰。

法務部政務次長陳明堂今晚說，愛丁堡地方法院第二天審理林克穎引渡庭，英國時間昨天十時 (台灣時間晚上六時)開庭，法官馬凱弗（Kenneth MacIver）一開庭即裁示，他認定台灣是具有「領地」地位的政治實體。

陳明堂指出，法官裁示台灣對林案有管轄權後，引渡庭即進入實質審理程序，了解林克穎在台灣肇事及受審經過。庭訊迄英國下午一時結束，暫時休息，下午將繼續開庭審理。

林克穎的律師在昨天的首日庭訊中質疑台灣與英國沒有邦交，也不具英國二００三年引渡法案第一九四條規定的「領地」（Territory）地位，因此台灣與英國於去年十月十六日簽署的「有關林克穎引渡備忘錄」無效。
