出售限期禁止做建築使用的都市土地，持有期間未滿二年，仍應報繳特種貨物及勞務稅（奢侈稅）。

財政部表示，依法令規定有明確期間禁止作建築使用或可申請臨時建築使用的都市土地，因亦具潛在開發價值，極易成為短期炒作標的，並引發房價異常上漲。

財政部因此規定，若出售持有期間在二年以內，依法令規定有明確期間禁止作建築使用的都市土地，除屬重劃中土地外，如是在2013年12月12日前已簽訂買賣契約而未申報者，需補報繳奢侈稅但免處罰鍰。
