日月光申請停止執行 高市府研議

高雄市環保局本月勒令日月光K7廠廢水含鎳的廠區停工，今天日月光向高雄市環保局申請停止執行，環保局將此案轉給法制局。但日月光是直接申請停止執行或提訴願，市政府相關單位要研究相關內容，才能確定並依相關規定辦理。

高雄市政府熟悉訴願程序的人士指出，根據訴願法第93條，原行政處分的執行，除法律另有規定外，不因提起訴願而停止。原行政處分的合法性顯有疑義者，或原行政處分的執行將發生難以回復的損害，且有急迫情事，並非為維護重大公共利益所必要者，受理訴願機關或原行政處分機關得依職權或依申請，就原行政處分之全部或一部，停止執行。前項情形，行政法院亦得依聲請，停止執行。

據了解，日月光如不是提訴願，直接申請停止執行停工裁罰，可能與訴願法的規定不符。
