猥褻亡友妻 憂鬱男判3年

（中央社記者黃意涵台北6日電）患有重度憂鬱症的林姓男子誆稱亡友託夢要他代為照顧，潛入亡友妻子家強抱對方。最高法院依侵入住宅強制猥褻罪判刑3年。

根據判決書，患有重度憂鬱症的林姓男子於民國100年2、3月間，假借亡友要他代為照顧妻小等理由，協助亡友妻子更換位於台中市住處的門鎖，並擅自留存1支鑰匙，他並向對方稱朋友託夢要他代為照顧。

林男去年7月間清晨持私留的鑰匙潛入亡友妻子家中後，脫去自己的上衣後強行抱住亡友妻子，並阻止對方拿手機求救，還恫嚇「不可以跟我老婆講」；被害人待林男離去後，報警處理。

最高法院審理後，維持台灣高等法院台中分院認定，審酌林男患有重度憂鬱症且住院治療，辨識違法能力降低，犯後也賠償被害人新台幣18萬元，依侵入住宅強制猥褻罪判刑3年定讞。1021206
