開刀後雙眼失明　長庚醫院判賠千萬

【張欽／台北報導】患有甲狀腺突眼症的吳姓男子，2007年經長庚醫院褚姓醫師動2次眼窩減壓手術後竟雙眼失明，吳男不滿褚姓醫師有醫療疏失且未告知其手術風險，提告向醫師及長庚連帶求償1255萬餘元，不過，台北地院認定醫師手術過程中並無過失，但醫護人員確未善盡告知義務，屬長庚的醫療給付不完全責任，僅判長庚要賠吳男1千萬餘元，全案可上訴。
 
吳男主張，2007年間因甲狀腺病變導致突眼症，到林口長庚求診後，由褚姓醫師進行2次眼窩減壓手術，不料，術後因視神經被壓迫而喪失光覺且瞳孔放大，最後雙眼失明，他認為醫師手術過程有疏失且術前未告知風險，控告醫師過失重傷害，並連帶向醫院求償。
 
褚姓醫師辯稱，手術符合醫療常規，術前有告知會有副作用及併發症，且有視力受損風險。刑事部分褚醫師獲不起訴處分，醫審會也鑑定手術沒疏失。民事部分法官則認定，醫師手術沒過失，但他未盡告知義務，而該行為屬長庚的醫療給付不完全責任，僅判長庚要賠吳男醫藥、工作損失、勞動損失及慰撫金等共1千萬餘元，醫師免賠償。全案可上訴。
